Cognya, available at cognya.co.uk, is operated by Fayyad Uddin trading as Cognya, at 159 Micklefield Road, High Wycombe, HP13 7HA, United Kingdom. Contact us at support@cognya.co.uk. References to “Cognya”, “we” and “us” mean Fayyad Uddin trading as Cognya.

These terms govern the service we provide to tutors and education professionals. When you create an account and accept these terms, you enter into an agreement with us. If you act for an organisation, you must have authority to bind it. “You” means that organisation or, if you subscribe personally, you.

The Data Processing Addendum forms part of this agreement for student information we process on your behalf. Our Privacy Policy explains our use of personal information. Reading or acknowledging that policy is not blanket consent to every use of information.

You must be at least 18 and use your tutor account for your tutoring or professional educational activities. Cognya is designed principally for GCSE and A-level teaching. Student homework features are available only to students who have already turned 14. A student’s school year or the difficulty of a worksheet does not establish their age. Year 9 students may use those features only if they are already 14 or over.

Students do not create tutor accounts. They access assigned homework using a passcode supplied by their tutor. You are responsible for choosing suitable material and supervising its educational use.

Before enabling homework access, you must take reasonable steps to check that each student is aged 14 or over and provide an accurate, separate confirmation for that student. Tell us promptly if a confirmation was incorrect. We may suspend the affected student’s access while investigating. These responsibilities do not exclude or limit Cognya’s own obligations under data-protection law.

Provide accurate account information and keep your sign-in credentials secure. Where available, you may sign in using Google. Do not share your tutor account with students or other tutors.

You are responsible for activity you authorise and for taking reasonable steps to protect your account. Tell us promptly if you suspect unauthorised access. This does not make you responsible for security failures caused by us.

Give homework passcodes only to the intended student or an appropriate parent or guardian. Do not post live passcodes publicly. Contact us if you believe a passcode has been disclosed or used by someone else.

Before adding a student or assigning homework, establish an appropriate lawful basis for the relevant processing and sharing. Provide students, and parents or guardians where appropriate, with the necessary privacy information; our student privacy notice is shown in the homework portal and can help with this. Obtain parental permission where it is required. Consent is not the only possible lawful basis and these terms do not determine the correct basis for every tutor.

Enter only information needed for the service. Do not put unnecessary identifying information, health information, safeguarding details or other sensitive personal information in worksheet instructions, feedback or student notes. Cognya does not currently provide reference-file uploads.

Our Privacy Policy describes student data processing, including limited manual quality checks carried out for our own purposes. Your acceptance of these terms does not, by itself, give consent on a child’s behalf for those separate activities.

Cognya uses AI to generate worksheets and mark schemes. Review them before assigning, printing or sharing them. Generated material can contain mistakes, omissions or material unsuitable for a particular student. We do not guarantee endorsement by an examination board or any particular examination result.

Homework is marked in two ways:

• Rule-based marking compares answers with accepted numbers, keywords or other configured rules.
• AI-assisted marking assesses eligible written answers against the question and mark scheme. These may include explanations, “show that” questions and longer written responses.

Both methods can make mistakes. Tutors can review and change AI-awarded marks. The current service does not allow tutors to override rule-based marks. Report suspected errors through the support facility or by email. Do not treat a disputed automatic mark as a definitive assessment of a student’s ability.

Progress indicators and results are teaching aids, not formal qualifications or a substitute for professional judgement.

The price and billing period are shown before a paid subscription is purchased; current prices are on our Pricing page.

On a paid plan, worksheets remain available while the subscription is active. On the Free plan, a worksheet is ordinarily available for 3 weeks after creation; expired worksheets remain in the Expired list for 7 further days, and upgrading during that time makes them available again. Hiding or expiry does not necessarily delete stored information. See the Privacy Policy for retention.

When a paid plan ends, your 5 most recent worksheets remain available under the Free plan for 3 weeks, and your other worksheets are archived: shown in your account but not available to view, download or set as homework until you subscribe again, when they are restored. Archived worksheets are deleted 12 months after they are archived. Homework already set continues until its due date. Downgrade alone is not an instruction to erase student records.

Selected tutors may receive Pro access free for one calendar month from activation. We will confirm their activation and expiry dates.

No payment card is required for this beta and it does not convert automatically into a paid subscription. At the end, the account moves to the Free plan unless the tutor separately chooses a paid subscription and supplies payment details. Choosing a paid subscription involves a separate payment commitment explained at checkout.

Moving to Free does not immediately close the account or erase its data. Free accounts are deleted after 30 consecutive days with neither a tutor sign-in nor student homework activity associated with that account. Either type of activity restarts that period. We will warn the tutor by email before deletion and explain the deadline and how to keep the account active. The Free-plan limits and the retention arrangements in the Privacy Policy apply. Tutors may also delete their accounts, students and homework through the available controls.

Beta features may change and may contain defects. We may suspend a feature to address security or serious reliability concerns, and will give reasonable notice of other significant beta changes where practicable. Tell us about problems through the support facility. Participation does not require a positive review or endorsement.

Paid subscriptions are billed monthly or annually, as selected at checkout, in GBP. The total payable, including any applicable taxes, and renewal arrangements will be shown before purchase. Annual billing does not mean the full annual worksheet allowance is available immediately.

Paid subscriptions renew for the selected billing period until cancelled. Not using the service does not cancel a paid subscription. Cancel through account settings before the next renewal to prevent the next charge. Cancellation normally takes effect at the end of the paid period, when the account moves to Free.

Instead of cancelling, a monthly subscription may be paused once in any 12 months, for one, two or three months. The pause starts at the end of the period already paid for. Nothing is charged while paused, and the account is read-only: worksheets, students and results are kept and can be viewed and downloaded, homework already set continues to its due date, but new worksheets and new homework are not available. Billing restarts automatically on the date shown when the pause was set, or earlier if you resume it, when a new billing period starts and is charged. Annual subscriptions cannot be paused.

The 30-day inactivity-deletion rule applies only to Free accounts, not accounts with an active or paused paid subscription or an active Pro beta. On moving to Free, an account receives a full 30-day inactivity period starting from the downgrade date, restarted by a subsequent tutor sign-in or student homework activity.

Before deleting your account, cancel any paid subscription yourself using account settings. Cognya prompts you to do this before deletion. Account deletion is not a substitute for subscription cancellation. Once the subscription has been cancelled, you may use the account-deletion control; deletion removes your account and associated student and homework records, subject to the limited legal-retention exceptions in the Privacy Policy.

We will give at least 30 days’ notice of a subscription price increase, apply it no earlier than the next renewal after that notice period and allow cancellation before it takes effect. We will not impose an increase retrospectively for an already-paid period.

Our Refund Policy explains contractual refund options, including any initial-purchase offer. Cancellation does not automatically produce a refund for the unused part of a billing period. Nothing in these terms or the Refund Policy removes rights or remedies that applicable law does not permit us to exclude.

If you experience a material service problem, contact us so we can investigate and provide an appropriate remedy.

Do not use Cognya unlawfully, infringe another person’s rights, upload or submit harmful or abusive material, introduce malicious software, attempt unauthorised access, disclose other people’s private information unnecessarily, bypass usage limits or security controls, or scrape, copy or resell the platform without permission. Restrictions apply only to the extent permitted by law.

The software, branding and platform materials are owned by Fayyad Uddin trading as Cognya or the relevant licensors. These terms do not transfer ownership of the platform to you.

You retain any rights you have in instructions and other material you submit. You give us the limited permission needed to process that material and provide the service. Only submit material you have the right to use.

Subject to any third-party rights, you may use, print, adapt and share generated worksheets and mark schemes with your own students and their parents or guardians for your tutoring practice. You may not sell them as a standalone resource product, operate a competing resource library using them, or represent that you own Cognya’s underlying technology. AI-generated output may not be unique or eligible for exclusive intellectual-property protection.

Generated questions and mark schemes may be included in a shared worksheet pool and reused or adapted for other tutors. This is an integral feature and there is currently no opt-out. Your permission to provide and reuse that generated content covers this pool. It does not authorise sharing student records, homework answers, tutor instructions or support messages in the pool.

We will provide the service with reasonable care and skill. Availability may be affected by maintenance, faults and third-party outages. We do not promise uninterrupted or error-free access. Where practicable, we will give notice of planned material interruptions.

We may suspend access where reasonably necessary to investigate unauthorised access, prevent harm, address serious misuse or deal with non-payment. We will explain the reason and opportunity to resolve it where lawful and practicable. Urgent security action may precede notice.

You may end the agreement by closing your account, subject to outstanding payment obligations. If we discontinue the service or terminate for reasons unrelated to your breach, we will give reasonable notice where practicable and address unused prepaid service fairly, including any refund required by law. Ending the agreement does not remove the data return and deletion obligations in the Data Processing Addendum.

Nothing in this agreement excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded or limited. It does not remove individuals’ statutory data-protection rights or the regulator’s powers.

For professional use, and only where lawful and reasonable, we are not liable for indirect or consequential losses or lost profits, business opportunities or anticipated savings. We do not guarantee a student’s grades or future educational outcomes.

Subject to the exclusions above and only to the extent lawful and reasonable, our total liability to you for claims relating to a paid subscription is limited to the fees you paid us for that subscription in the three months preceding the event giving rise to the claim. This fee-based cap does not apply to a free account or free beta period. Nothing in this clause limits liability that cannot lawfully be limited.

We may make reasonable changes for legal, security or service reasons. We will explain material changes and ask you to accept a new version before continuing, as appropriate. We will not use a change to remove accrued rights retrospectively. If you cannot accept a material adverse change during a paid period, contact us to discuss ending the service and any appropriate refund.

If operation moves to a limited company, we will identify the proposed new operator, explain any agreement or data-handling changes and follow the applicable legal requirements. Incorporation does not automatically make the company a party to this agreement.

If a provision is unenforceable, the remaining provisions continue to apply. These terms are governed by the law of England and Wales. Courts of England and Wales have jurisdiction, subject to any mandatory rights applying to an individual customer.
